Arbitration Agreement – A Clause for Dispute Resolution


What is an Arbitration Agreement or Clause?

An arbitration agreement—also referred to as an arbitration clause—is a legally binding provision where parties agree to resolve disputes through arbitration instead of court litigation. This clause is most commonly embedded within a broader commercial contract, but it can also exist as a standalone agreement depending on the nature of the relationship between the parties.

In practice, the arbitration clause sets out the parties’ mutual intention to submit any disputes arising out of or in connection with the contract to arbitration. It often includes details such as the arbitral institution, governing rules, seat of arbitration, and language.
